Oklahoma Eliminates State Sales Tax on Groceries

On February 27, 2024, Oklahoma Governor Kevin Stitt signed HB 1955, eliminating the state’s 4.5% tax on groceries. While the state sales tax on groceries will be eliminated once HB1955 takes effect, cities and counties can still impose local taxes on groceries. HB 1955 will take effect 90 days after the legislature adjourns this year’s session, which is constitutionally required by late May, meaning the tax repeal will take effect no later than August. Prepared food items, such as warm pizza and fruit bowls, remain subject to state sales tax.

Oklahoma Tax Commission Determines Taxpayer’s Prosthetic Device Sales Were Exempt from Sales Tax
An Oklahoma Tax Commission Letter Ruling (Okla. Tax Comm’n. Letter Ruling LR-19-020) clarified the sales of prosthetic devices are exempt from sales tax. The Taxpayer must sufficiently detail and disclose the qualifying prosthetic devices as a separate line item(s) in its invoice(s) to healthcare providers to qualify for the exemption.

Oklahoma Income Tax Return Now Due July 15
Oklahomans now have until July 15, 2020, to file and pay their 2019 Oklahoma income tax return. Following the Trump administration deciding to push the federal income tax filing date from April 15 to July 15, the Oklahoma Tax Commission (OTC) is likewise extending the 2019 Oklahoma income tax return due date from April 15 to July 15, 2020.
